MOTIFS DU JUGEMENT DE LA COUR
(prononcés à l'audience à Ottawa (Ontario) le 14 mars 2006)
[1] La demanderesse sollicite le contrôle judiciaire de la décision par laquelle la Commission du droit d'auteur (la Commission) a estimé que les défendeurs n'étaient pas tenus de produire toutes les questions d'examen qu'ils ont élaborées et ce, en vue de permettre à la demanderesse de découvrir lesquelles parmi ses oeuvres protégées par le droit d'auteur ont pu être reproduites dans les questions d'examen élaborées par les défendeurs. Il y a plus d'une centaine de défendeurs et la quantité de documents en cause risque d'être considérable. La Commission a refusé d'ordonner aux défendeurs de produire les documents en question en déclarant ce qui suit :
[TRADUCTION] Certains de ces renseignements ne sont d'aucune utilité, compte tenu du paragraphe 29.4(2) de la Loi sur le droit d'auteur. Les seuls renseignements à communiquer sont ceux qui ont trait aux questions d'examen reproduites à l'extérieur des locaux des établissements d'enseignement.
[2] Pour déterminer quels éléments les défendeurs doivent produire, la Commission s'est référée au paragraphe 29.4(2) pour expliquer pourquoi les questions reproduites dans les locaux de l'établissement des défendeurs n'étaient pas pertinentes dans le cadre d'une instance portant sur l'établissement du tarif. Les parties n'avaient formulé devant la Commission aucun argument au sujet du paragraphe 29.4(2) et c'est sans doute la raison pour laquelle les motifs de la Commission sont aussi brefs.
[3] À notre avis, la Commission devrait entendre, dans le cadre de son audience principale, les arguments des parties au sujet de la question de savoir si l'exception prévue au paragraphe 29.4(2) s'applique de manière à priver la demanderesse du droit d'exiger la fixation d'un tarif pour la reproduction de documents dans les locaux des établissements des défendeurs. C'est une question importante dont il y a lieu de tenir compte pour établir le tarif applicable et la Commission examinera certainement ces arguments avec un esprit ouvert parce qu'elle n'a pas encore eu l'avantage d'entendre de tels arguments. Nous ne croyons pas que cette question pourrait être tranchée de façon définitive dans le cadre d'une requête interlocutoire visant à déterminer quels documents les défendeurs doivent produire.
[4] Cette décision interlocutoire est de toute façon susceptible de contrôle judiciaire par notre Cour une fois que la Commission aura rendu sa décision définitive sur la question du tarif.
[5] À notre avis, le présent appel ne comporte les « circonstances spéciales » évoquées par notre Cour dans les arrêts Szczecka c. Canada, (1994) 116 D.L.R. (4th) 333 (C.A.F.) à la page 335, et Zundel c. Canada (Commission des droits de la personne), [2000] 4 C.F. 255 (C.A.F.), à la page 261.
[6] La demande de contrôle judiciaire sera rejetée avec dépens.
