REASONS FOR ORDER

NADON J.A.

[1]               The Attorney General of Quebec’s motion will be dismissed, because under section 57 of the Federal Courts Acts, R.S.C. 1985, c. F-7, she is entitled to adduce evidence and make submissions to this Court “in respect of the constitutional question” and, furthermore, under subsection 57(5), she is deemed to be a party to the proceedings for the purpose of any appeal in respect of the constitutional question.

[2]               Consequently, the Attorney General of Quebec is entitled to participate in the appeal as of right without necessarily obtaining leave of this Court.

[3]               In the event the parties cannot agree on a schedule regarding the submission of their respective records and their memoranda, they can ask the Court to determine this issue.
