ASSESSMENT OF COSTS – REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]               This is the assessment of the costs to be paid to the respondent following the decision dated January 10, 2006 dismissing the applications for judicial review filed by the applicants, with one set of costs and disbursements in each case.

[2]               As requested, the assessment was done without the personal appearance of the parties. Up to now, we have not received any answer to our letter dated May 2, 2006 establishing a timetable for the filing of written submissions.

[3]               In the circumstances, the respondent’s fees are allowed in an amount of $2,418 for the following items of Tariff B: 2 (7 units), 13 (5 units), 14 (3 units X 2h03min) and 26 (2 units). I reduced the number of units to 2 for the assessment because it was not contested. As far as the disbursements incurred in these cases are concerned, the evidence of which was established by affidavit, they are allowed for an amount of $647.92.

[4]               In conclusion, the respondent’s costs are assessed at $3,065.92. A certificate is issued for this amount in A‑66‑05, and a copy of these reasons is filed in the following dockets: A‑67‑05, A‑68‑05, A‑69‑05, A‑70‑05, A‑72‑05, A‑73‑05 and A-74-05.

DATED AT MONTRÉAL, THIS 28TH DAY OF JULY 2006
