THE CHIEF JUSTICE
[1] Applying the two step approach enunciated in Baroud v. Canada,1 it has not been shown that the motions Judge erred in the exercise of her discretion in dismissing the Plaintiffs' action for failure to show why it should not be dismissed on account of undue delay pursuant to Rule 382(2)a) of the Federal Court Rules, 1998.
[2] The appeal will be dismissed with costs.
