REASONS FOR JUDGMENT OF THE COURT

(Delivered from the bench at Montréal,

Quebec, on Monday, May 15, 2000)

DÉCARY J.A.

[1]          Despite Mr. de Merchant's argument, we are not convinced that there is any reason to intervene except, of course, with respect to the weeks which the respondent recognizes as weeks of unemployment.

                                             Page: 2

[2]          The application for judicial review will be allowed, the umpire's decision will be set aside and the matter will be referred back to the chief umpire or to an umpire designated by him for redetermination on the basis that the weeks between July 12, 1993, and December 10, 1993, were weeks of unemployment, but that the other weeks were not. There will be no award of costs.
