ASSESSMENT OF COSTS -- REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]      Pursuant to the judgment rendered February 27, 1997 dismissing the appeal with costs, the respondent filed her bill of costs on March 24, 2000 and requested a notice of appointment to proceed with the assessment of costs. On April 18, 2000, only Ms. Marie Bélanger of the Department of Justice was present, although her process had been served in the prescribed form on the appellant.

[2]      In view of the evidence filed in support of this bill of costs and the submissions by Ms. Bélanger at the time of the assessment, the fees requested under items 19 (5 units), 22a (2 units/2.5 hours) and 25 (1 unit) are allowed as such. Two (2) units are allowed for the assessment of the costs as this proceeding was not contested. The disbursements totalling $347.34 for photocopy expenses and service are also allowed.

[3]      The respondent's costs resulting from this appeal are assessed and allowed in the amount of $1,647.34 and a certificate shall issue for that amount.
