[1]      This is an assessment of the Respondent's costs pursuant to the judgment of the Court dated the 30th of April, 1998.

[2]      Ms Elizabeth Chasson appeared on behalf of the Respondent. No one appeared on behalf of the Appellant.

[3]      At the commencement of the assessment, Ms Chasson provided me with a copy of a letter received by her from counsel for the appellant, wherein they advised that they would not oppose this assessment. Ms Chasson also informed me that she was withdrawing the amount of $300.00 claimed on the Bill of Costs for this taxation.

[4]      Having satisfied myself that the remaining fee items in the Bill of Costs fall within the amounts permitted under column III of the tariff, I allow them as presented.

[5]      The amounts claimed as disbursements with the exception of the $3.00 for Toronto Legal Copies and an amount of $8.52 for Canada Communication Group, have been satisfactorily proven and are allowed in full.

[6]      The $3.00 for Toronto Legal Copies and $8.52 for Canada Communication Group not having been properly proven, are disallowed.

[7]      Having regard to the foregoing, the Respondents's Bill of Costs is assessed at $1,550.00 for fees and $574.17 for disbursements, for a grand total of $2,124.17. A Certificate for this amount will issue accordingly.
