While we are not convinced that the certified question arises out of the facts of this case, the record is sufficiently ambiguous that we are not confident that the Visa Officer correctly applied the relevant regulations to this application. For this reason, the appeal will be allowed, the decision of Wetston J. and the decision of the Visa Officer will be quashed and the matter will be remitted to a different Visa Officer for redetermination. |
