[1]                              On August 10, 2001 Martin Gentile filed a bill of costs on behalf of the respondent following the judgment rendered by the Court on November 3, 2000 dismissing with costs the appeal and the cross-appeal.

[2]                              Mr. Gentile having requested that his bill be taxed in writing, letters were sent to the parties on August 7, 2001 inviting them to file and serne their representations. As no representations were received within the specified deadlines, the bill is assessed.

[3]                              The claims for fees under each item were considered and, in the absence of opposition, are awarded except for:


Item 17: Mr. Gentile claims fees under this item for preparing and filing notices of intention to participate in the appeal, whereas the services payable under this item are for the preparation, filing and service of the notice of appeal: this request is therefore denied;

Item 26: As there was no opposition, the application under this item is reduced to $330.

[4]                              The claim for disbursements in the amount of $5,300.99, supported by counsel's affidavit with supporting invoices, is allowed.

[5]                              The respondent's costs are assessed and allowed in the amount of $1,430 for fees and $5,300.99 for disbursements. A certificate is issued in the amount of $6,730.99.
