THE CHIEF JUSTICE


[1]      Given the undisputed facts before the Tax Court Judge, 98-1062(UI), the judge did not err in concluding that the hours in question were hours that the respondent "actually worked" in accordance with Regulation 9.1.1

[2]      Accordingly, the application for judicial review is dismissed.

[3]      Costs are awarded to the respondent.
