[1]        This motion may be decided on the basis of the written representations submitted by the parties.


[2]        The Court adopts the approach and reasoning set forth by the defendant in paras. 1 to 47 of his written representations filed on March 1, 2002.

[3]        This motion is accordingly dismissed, with costs to follow. In the circumstances, I do not consider it would be justified or proper to dismiss the instant motion with costs, still less with costs awarded personally against counsel for the plaintiff.
