[1] Upon the applicant has failed to justify the delay and demonstrated that exceptional circumstances exist;
[2] Upon the applicant has failed to specify when he sought legal advise and retained counsel in Canada;
[3] Upon the applicant"s solicitor has filed an affidavit and has presented argument to the Court based on that affidavit;
[4] Upon the applicant"s solicitor has not complied with Rule 82 of the Federal Court Rules 1998.
[5] For these reasons, THIS COURT ORDERS that:
The applicant"s motion for extension of time be dismissed.
