     - and -

     ORDER AND REASONS FOR ORDER

Nadon J.:

At the end of the hearing of the Respondents" motion to extend the time for the filing of the Respondents" affidavits, I indicated to counsel that the motion would be allowed.

Counsel for the Applicant then made a request, which was not opposed by the Respondents, that I order the production of those documents referred to at paragraph 84 of its originating notice of motion. I ordered the Applicant to give notice to all interested parties of the Applicant"s intention to file and rely on these documents. I indicated to counsel that if at the end of 30 days no objection to the production had been received, the Applicant could then produce the documents. However, should any interested party wish to oppose, the Applicant shall make an application seeking leave to produce the documents.
