ASSESSMENT OF COSTS - REASONS

FRANÇOIS PILON

Assessment Officer

[1]        Following a hearing lasting half a day the plaintiff's action was dismissed with costs on June 12, 2001. On August 16, 2001 Rosemarie Millar filed her bill of costs on behalf of the defendant and asked that it be assessed without a personal appearance by the parties. As no written submissions were received within the deadlines specified by the Registry, we will proceed to assess the bill of costs of Her Majesty the Queen.

[2]        As taxable services Ms. Millar claimed the following items:

item 2                 4 units

item 7                 3 units

item 10 3 units

item 11 2 units

item 13(a)          3 units

item 14(a)          2 units

item 25 1 unit

item 26 4 units

All these claims seem reasonable in the circumstances and will be awarded.

[3]        The disbursements to be assessed are proven in the affidavit in support of the bill of costs and are awarded in the amount of $2,807.25. The defendant's costs are allowed and assessed in the amount of $5,852.25. A certificate of assessment will be issued for this amount.
