Written motion by the defendant to:

(a)         obtain directions following the plaintiffs' refusal to provide adequate replies to the defendant's written questions; and

(b)        to obtain an order directing Aurélien Haché, Bernard Duguay and Marc Couture to undergo another examination for discovery;

(c)        with costs.

                                            REASONS FOR ORDER AND ORDER

[1]                After reading the parties' records on the motion at bar, the Court must make the following order:

            (a)        none of the arguments made by the plaintiffs, including their interpretation of Tremblay-Lamer J.'s judgment, can exempt them from providing a reasonable reply to the particulars sought by the defendant in her letter of January 6, 2004;

(b)        those particulars must therefore be provided on or before June 22, 2004;


(c)        as this requirement has already been the subject of paragraph 3 of this Court's order dated February 12, 2004, the plaintiffs are hereby ordered to pay costs of $500, which they will pay the defendant within 20 days of the instant order.

[2]                As regards the order sought by the defendant directing Aurélien Haché, Bernard Duguay and Marc Couture to undergo another examination for discovery, I do not think that the defendant's motion record fully justifies the necessity of this step, as required in paragraph 2 of the order of February 12, 2004. Consequently, the defendant is denied this remedy.

[3]                At the same time, pursuant to paragraph 4 of the order of February 12, 2004, the parties will ensure that the stages in Rules 257 and 258 are carried out as follows:

(a)        they will undertake a settlement discussion pursuant to Rule 257 on or before August 3, 2004;

b)         in the plaintiffs' case, they will serve and file an application for a pre-trial conference pursuant to Rule 258 on or before August 31, 2004.
