                                               REASONS FOR ORDER AND ORDER

[1]                 Upon reviewing the motion records of the parties, I am satisfied that the above-mentioned motions shall be adjudicated upon as follows.


Respondent's Motion

[2]                 The Respondent's motion is granted as follows.

[3]                 The Court grants leave to the Respondent to serve and file the transcription of the testimony of Denise Beaudoin given on November 28, 2001 during the trial of Raymond Turmel before the Cour du Québec, Chambre criminelle, produced as Exhibit "A" to the affidavit of Guy Pinsonnault, as a supplementary record to be served and filed within five (5) days of the date of this order.

[4]                 The Court is satisfied in that respect that it is likely that that supplementary material will serve the interests of justice, assist the Court in making its final determination, and not seriously prejudice the other side.

[5]                 Costs of this motion are in the cause.

Applicant's Motion

[6]                 The Applicant's motion is granted in part as follows.

[7]                 The Court grants leave to the Applicant to serve and file the affidavit of Denise Beaudoin sworn March 20, 2002. The said affidavit shall be served and filed within five (5) days of the date of this order.

[8]                 As for the fourteen (14) additional documents that the Applicant seeks to introduce into evidence, the Applicant's motion is denied in that respect as I am of the view that none of the said documents deal with the decision at issue. Therefore the impugned documents would not assist the Court in making its final determination on the merits.

[9]                 Costs of this motion are in the cause.
