[1]      Having reviewed the file I became aware that the Respondents have chosen not to file any pleadings; in the interest of justice I have determined not to strike the affidavit of Dr. Jacques Messier. In my view he does not proffer any legal conclusions; he is providing the court with an overview of the legislation.


[2]      Finally I would suggest that this matter should be left up to the judge hearing the matter on the merits.
