ASSESSMENT OF COSTS - REASONS

MICHELLE LAMY, ASSESSMENT OFFICER

[1]      This action was discontinued on August 30, 2000. Pursuant to Rule 402 of the Federal Court Rules, the Defendant filed on October 12, 2000, its bill of costs and requested an assessment without appearance of the parties.

[2]      The Plaintiff was accordingly notified that it was required to file written representations by November 8, 2000. As of today's date, no representations have been received from the Plaintiff.

[3]      In light of the above, the Defendant's bill of costs is taxed as is. The Defendant is allowed $500,00 under item 2 of Tariff B, Column III, for the preparation and filing of its defence. A certificate is issued for that amount.
