The City of Chilliwack's motion to intervene is allowed in respect of the injunctive relief sought by the Applicants / Plaintiffs. With respect to intervention in the substantive proceedings, which are now to be dealt with by way of an action, the City is given leave to seek intervenor status from the case management judge who will be appointed by the Associate Chief Justice.

In that regard I have requested the office of the A.C.J. to bring this matter to the attention of the A.C.J. as soon as possible. It will be preferable, in my view, to have the issues between the parties better defined before deciding whether the City ought to participate in the litigation of those issues. There shall be no costs on this motion.
